Terms & Regulations:

  • Application Period : Friday, November 1st, 2018 - Thursday, January 31st, 2019.
  • Vendors are responsible for Parking fees ($10.00 per day/per vehicle)
  • All companies/vendors are required to have their Hawaii Business or Hawaii GE license (a copy is fine.) and a Certificate of Liability Insurance.
  • Please list “Honolulu Festival Foundation, P.O.Box 8494, Honolulu, HI 96830” as a certificate holder. Please add Honolulu Festival Foundation as additional insured.
  • A Food vendor (Whom selling a food & Beverage related items) must to prepare a Temporary Food Establishment Permit.
  • Reselling the booth space to other vendor is prohibited.

Event Information:

  • Location of the event : 1st Level Exhibit Hall at Hawaii Convention Center.
  • Date of the event : Saturday, March 9th and Sunday, March 10th.
  • Time of the event : Saturday the 9th : 10:00AM-6:00PM, Sunday the 10th : 10:00AM-3:00PM.

Set-up Information:

  • Booth location will be assigned by Honolulu Festival Foundation in advance and will be informed to you.
  • First come, first assigned. We do not take any request for the booth location.
  • General setup Date & Time : Friday, March 8th, 3:00PM-8:00PM.
  • Event day setup time : Saturday the 9th : 9:00AM-10:00AM, Sunday the 10th : 9:00AM-10:00AM.
  • Vendors are responsible for all products and personal items.

Photo Release Agreement:

In consideration of participating in the 25th Honolulu Festival, I consent to the photographs and/or video recordings of my performance and grant ”Honolulu Festival Foundation” the right to copy, reproduce and use all or any portion of the said photos and/or videos for all purposes, including, but not limited to advertising, or any commercial materials.

Vendor Agreement:

The Vendor named below agrees to defend, protect, indemnify, and hold harmless the Honolulu Festival Foundation, including its directors, officers, representatives, agents, employees, and volunteers, from any and all claims which are alleged to arise, either in whole or in part, out of any alleged negligence or fault of the Honolulu Festival Foundation.

During the life of the contract and for such additional time as may be required, the Vendor will provide, pay for, and maintain in full force and effect the insurance outlined here for coverages at not less than the prescribed minimum limits of liability, covering the Vendor’s activities, those of any and all sub-contractors/consultants, or anyone directly or indirectly employed by any of them, or by anyone for whose acts any of them may be liable.

The Vendor will give the Honolulu Festival Foundation a certificate of insurance completed by a duly authorized representative of their insurer certifying that: (1) at least the minimum coverages required herein are in effect; (2) specifying that said liability coverages are written on an occurrence form; and (3) that the coverages will not be canceled, non-renewed, or materially changed by endorsement without 30 days advance written notice to:

Honolulu Festival Foundation will have the right to prohibit the Vendor or any sub-contractor contracted by the Vendor from entering the event site until such certificate or other evidence that insurance has been placed in complete compliance with these requirements is received and approved by Honolulu Festival Foundation. The Vendor’s failure to maintain the required insurance may result in termination of this contract.

Below are the minimum insurance coverage requirements for all Vendors:

  • Commercial General Liability (include Liquor Liability if applicable)

    $2,000,000 Products & Completed Operations Aggregate
    $1,000,000 Personal & Advertising Injury
  • Automobile Liability
    $1,000,000 combined single limit each accident
  • Workers’ Compensation & Employers’ Liability
    $1,000,000 bodily injury for each accident
    $1,000,000 bodily injury by disease for each employee
    $1,000,000 bodily injury disease aggregate
  • Umbrella/Excess Liability
    $1,000,000 combined single limit and aggregate limit

The policy or policies providing insurance as required, with the exception of workers’ compensation, will defend and include Honolulu Festival Foundation and its directors, officers, representatives, agents, employees, and any other entity required by Honolulu Festival Foundation as additional insureds. The form of the additional insured endorsement will be ISO CG 20 10 11 85 or its equivalent. The amount of the Vendor’s insurance required by this Agreement will not be reduced by or affected by the existence of any other insurance, whether secured by Honolulu Festival Foundation or any other person or entity, that might provide coverage for any claim arising out of any alleged negligence or fault on the part of Vendor.
All coverages required of the Vendor will be primary over any insurance or self-insurance program carried by Honolulu Festival Foundation and the Vendor’s insurer will not seek contribution from other insurance available to Honolulu Festival Foundation.
The Vendor will require all insurance policies required by this Agreement to include clauses stating each insurer will waive all rights of recovery, under subrogation or otherwise, against the Honolulu Festival Foundation. The Vendor will require of sub-contractors, by appropriate written agreements, similar waivers of all rights of recovery, under subrogation or otherwise, against the Honolulu Festival Foundation.

The Vendor acknowledges that it has read this Agreement and has received or waived the opportunity to discuss the Agreement and its ramifications, legal or otherwise, with legal counsel. Further, the Vendor acknowledges that it fully understand the terms of this Agreement and acknowledges that it has signed it freely and voluntarily without any inducement assurance, guarantee, or oral representation being made by anyone acting, or purporting to act on behalf of Honolulu Festival Foundation.
